TERMS OF SERVICE

These Terms govern the use of artegomagazine.com (the “Website”) and services offered by Artego Magazine. The Website is operated by MARINA ABRAMOVA PR IZDAVANJE ČASOPISA I PERIODIČNIH IZDANJA MARIKA ART SHOW BEOGRAD, Koste Glavinića 10A, 11000 Belgrade, Serbia (the “Operator”). Simply browsing the Website does not create a paid service contract.

SECTION 1 — SERVICES

Artego Magazine is a digital and print photography magazine. We may offer free editorial review and optional paid editorial or promotional services described in the current Media Kit or on the relevant ordering page. Print or digital copies may be sold by MagCloud or another identified third-party seller under that seller’s terms. Availability, timing and deliverables are those confirmed for the specific order.

SECTION 2 — ORDERS, SELLER AND PAYMENT

Artego uses external submission and payment channels, including Kavyar and Artells Media. Before payment, the ordering page should identify the seller, total price and currency, service scope and deliverables, timing, start of performance, cancellation and refund conditions, and the terms that apply. When the Operator is the seller, the Operator details in Section 13 apply. When an identified third party is the seller, that party’s ordering terms apply to its sale. We do not collect or store card details when payment is processed by a third party. Do not pay if the required order information is missing or unclear.

SECTION 3 — CONSUMER RIGHTS AND WITHDRAWAL

Mandatory consumer law always prevails over these Terms. If a statutory withdrawal right applies, the applicable period, method and any lawful exceptions must be explained at the ordering step. A service may begin before the withdrawal period ends only after the seller obtains any separate express request or acknowledgement required by law. Early performance is not requested merely by browsing the Website, submitting work or accepting these general Terms. Any loss or reduction of a withdrawal right applies only where the law permits it and the required information and acknowledgements have been provided.

SECTION 4 — EDITORIAL REVIEW

Free and paid submissions remain subject to editorial review unless a specific ordering page expressly describes an approved placement after the application has been accepted. Payment alone is not a guarantee of publication. Any confirmed placement, deliverable, deadline or remedy must be stated in the accepted order.

SECTION 5 — RESTRICTED WORK, RIGHTS AND RELEASES

Do not use the general Kavyar or Artells submission links for work featuring anyone under 18 or for nude or intimate work. Contact editor@artegomagazine.com before sending files and never email identity documents; a safe review process must be agreed first. For all other submissions, you confirm that you hold the necessary copyrights, model releases and permissions and that the work does not unlawfully infringe third-party rights.

SECTION 6 — REVIEW AND PUBLICATION LICENCES

Submitting files for editorial review grants only a limited, non-exclusive licence necessary to receive, store and review those files. Publication, promotion, cropping, retouching or other use requires the separate licence or submission agreement applicable to the accepted work, including any platform terms shown before submission. You retain ownership of your work. If separate agreed terms conflict with this Section for a specific accepted submission, those specific terms govern that submission.

SECTION 7 — PROHIBITED CONTENT AND CONDUCT

You must not submit unlawful content, content that infringes third-party rights, sexualised content involving a person under 18, malware or material intended to deceive or harm others. Material may be rejected or removed where age, consent, authorship or rights cannot be verified.

SECTION 8 — THIRD-PARTY PLATFORMS

Kavyar, Artells Media, MagCloud and social networks are independent services with their own terms and privacy practices. The Operator remains responsible for its own obligations but does not control a third party’s systems, availability or separate sales. Review the identified third party’s current terms before using it.

SECTION 9 — LIABILITY

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including mandatory consumer rights. To the extent permitted by law, neither party is liable for indirect or unforeseeable loss. No limitation applies to fraud, wilful misconduct, gross negligence, or death or personal injury where exclusion is prohibited.

SECTION 10 — CHANGES

We may update these Terms prospectively. Material changes do not retroactively alter an already accepted paid order. The version presented or linked when an order is accepted governs that order unless a mandatory law requires otherwise.

SECTION 11 — GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the Republic of Serbia, without depriving consumers of mandatory protections available under applicable law. Court jurisdiction and out-of-court dispute rights are determined by mandatory law. Please contact us first so that we can try to resolve a concern.

SECTION 12 — COMPLAINTS

Complaints about a service sold by the Operator may be sent to editor@artegomagazine.com. We will acknowledge and handle complaints within the deadlines required by applicable Serbian consumer law. This does not limit the right to contact a competent authority, consumer organisation or available out-of-court dispute-resolution body. Complaints about a sale by an identified third-party seller should also follow that seller’s published procedure.
